Ontario Dog Bite Injury – Can I Sue?

The answer is Yes!

Making Dog bite civil claims are a statutory right in Ontario.

What is a statutory right, you ask. An statutory right is something that the Government has bestowed by enacting a binding legal document at the parliament, that is referred to as a Statute or an Act.

In Ontario, this legal document for dog bite claim matters is called Dog Owners’ Liability Act, R.S.O. 1990, c. D.16. This Statute or Act was enacted at the Ontario Provincial Parliament.

Section 2(1) of this Act establishes dog owner’s civil liability thus:

(1) The owner of a dog is liable for damages resulting from a bite or attack by the dog on another person or domestic animal. 

So yes, you can definitely sue the attacking dog’s owner post dog bite.

However, suing does not always translate to winning the case or getting a just compensation. And There’s the rub.
